Disciplinary Hearing

A disciplinary hearing gives an employee an opportunity to respond to allegations and evidence before an employer makes a disciplinary decision. The required process depends on law and workplace arrangements.

Example

An employee receives details of the concern and relevant evidence before a hearing where they can explain their position and raise relevant information.

What to keep in mind

The decision should remain open until the response is considered. Check rights to notice, assistance or representation and appeal, and distinguish the hearing from a preliminary fact-finding interview.
